The Customer agrees to have read, understood and accepted all the below terms and conditions (electronically or by signature) upon payment.

The General Terms and Conditions govern your access, use and orders placed at www.maeke.com.au (the “Site”) as well as the provision and sale of products and services by Maeke.

The Digital and Printed Products and Hire Terms and

apply to the products and services listed below. Where there is a difference between these General Terms and Conditions and the Digital and Printed Products and Hire Terms and Conditions, the Digital and Printed Products and Hire Terms and Conditions shall take precedence.

The Privacy Policy that outlines how Maeke collects, uses, shares, discloses, stores and secures information you provide through the use of our website, procurement and use of our products and services.

You can review the most current version of these Terms and Conditions at any time at this page. We reserve the right, at our sole discretion, to update,
change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Products and Services following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

1. Applicability

By accessing or using this Site, you agree to be bound by these General Terms and Conditions, any Digital and Printed Products and Hire Terms and Conditions and to any additional guidelines, restrictions, or rules that may be posted in connection with specific products or services on this Site.

Every Maeke product and/or service on this Site as well as every transaction that is concluded through our Site is governed by these General Terms and Conditions.

The applicability of any terms and conditions of the Customer or any third party on behalf of the Customer is expressly dismissed and shall not apply, even if Maeke has not specifically rejected them.

2. Copyrighted Materials for Limited Use

This Site contains logos, designs, graphics, photographs, images, document layouts, artwork, text, fonts and any other information (referred to herein as “Content”). This Site and all Content are the copyrighted property of Maeke. All rights in this Site and its Content are reserved worldwide.

It is strictly prohibited to retain, copy, distribute, publish, or use any portion of the Content except as expressly allowed in these General Terms and Conditions or permitted by Maeke.

3. Use of our Site and its Contents

You are granted permission to access and use this Site and its Content for the sole purpose of preparing, evaluating, and ordering products or services solely through Maeke.

By placing an order on this Site, you warrant that you have all necessary permission, right and authority to place the order and you authorise Maeke to produce the products on your behalf.

4. Use of Customers Content

You grant Maeke the right to copy, modify, distribute, use, create derivative works of and vectorise any content you have provided for the purpose of fulfilling your order.

Pricing for custom designs begins with a design fee and then a printing fee which correlates with our online ordering structure.

*Please be aware that our design fee does not entitle you to any final artwork files that were created.

All artwork that Maeke create for you remains the sole property of Maeke.

5. Transfer of Title

The Customer agrees that the risk of loss and title for any delivered product pass to you upon our delivery to the carrier. We make sure when packing your order that everything is packed to the best of our capabilities and with the upmost of care, at the end of the day your order is just as important to us as it is to you. If damages do occur, please get in contact with us ASAP and we will work together to see if there is anything we can do to help the situation.

For any product that is to be provided to the Customer in an electronic format, the Customer agrees that delivery of such product shall be deemed to have occurred either (a) at the time Maeke transmit the product via email or other electronic communication addressed to the Customer.

6. Site Feedback

Any comments, suggestions or other feedback provided by the Customer to Maeke is on a non-confidential basis. All such comments, suggestions, and other information shall become the exclusive property of Maeke and you agree that Maeke shall be free to use such information on an unrestricted basis.

7. Indemnification

You agree that you shall indemnify Maeke, and their partners, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to your breach of these General Terms and Conditions.

8. Governing Law, Jurisdiction and Dispute Resolution

Your access to or use of this Site and all issues related to the protection, infringement, or misuse of copyrighted materials shall be governed by the laws of the Australian Capital Territory, Australia.

9. Pricing

All prices on the site are in Australian Dollars (AUD).

Prices for our products and services are subject to change without notice.

10. Supply

Maeke is not liable and shall accept no responsibility for inability to supply products due to terrorist activity, acts of God, fire, flood, war, strikes or sabotage.

1. Custom Designs

A custom design is either a concept brought to Maeke to bring to life, or a design Maeke has worked on with the client.

Pricing for custom designs begins with a design fee and then a printing fee which correlates with our online ordering structure.

Any custom Digital or Printed Product(s) designs and artwork created by Maeke remain the sole-property of Maeke.

2. Proofing

Maeke shall provide a screenshot image of your invitation design by email for each proof.

We will do what we can to pick up any obvious errors we may see during the proofing process, however final proofing is the sole responsibility of the Customer.

For each order, you get 3 artwork proofs which means two rounds of changes to your artwork before printing begins. Once you receive your initial proof from us, it is important that your very carefully read and check for any errors that need changing. Once you have checked the proof, please email us with any changes you want to make. This is counted as 1 proof.

If you do need additional changes to your proof, you will be charged $50 for each round of changes which will need to be paid before printing begins on your stationery.

Payment must be received before any artwork proof is sent to you for approval/changes.

Maeke may at our discretion improve your design/layout if your wording requires more/less space to achieve the best result for you.

3. Cancellation and Refund Policy

The Customer may cancel an order at any time but acknowledges that if Printed Products have been ordered from our third-party printer after final proof approval, all payments are non-refundable.
If the order for Printed Products has not been placed with our third-party printer a full refund less a reasonable design service fee will be made.

If the order is for digital invitations, the Customer may cancel an order at any time but acknowledges that if the final approved Digital Products (.jpeg and png file) have been provided, all payments are non-refundable. If the final approved Digital Products (.jpeg and .png file) have not been provided a full refund less a reasonable design service fee will be made.

If your Printed Products do not match your approved proof, please contact us immediately and we will reprint the affected Printed Products free of charge.

*REPRINT CHARGES FOR PRINTED PRODUCTS
If Printed Products have been ordered from our third-party printer after final proof approval and the Customer requires further changes to be made, a further reprint charge of the total order value will apply.

4. Printed Products Availability

All Printed Products are subject to our third party printers paper stock availability.
If paper stock is unavailable we will get in contact with you and work together on a solution.

5. Pick Up or Delivery of Printed Products

Printed Products can be picked up by the Customer at a location determined by Maeke.

If the Customer requests Maeke to deliver the Printed Products, the Customer agrees to pay the delivery fee.

Hire terms and conditions

Definitions

1. Hirer - Maeke ABN 54 967 768 310.
2. Customer - refers to any individual, couple or organisation hiring Hire Item/s from the Hirer.
3. Hire Item/s - refers to all signs, sign stands, wishing wells, table numbers and any other item/s from our Hire collection (including any accessories and packaging) supplied to the ‘Customer’.

1. Hire Period

The hire period for all Hire Item/s is 4 days from time of pickup or upon receipt of delivery.

2. Security Bond

All bookings will include a security bond at time of payment. The security bond (minus any late return and/or replacement fees) will be refunded to the Customers provided bank details upon the return/collection of Hire Item/s if they are in the same condition as when picked up or delivered by the Hirer.

The amount of security bond held will be 50% of the total for all Hire Item/s.

3. Payment

At the time of booking the Customer is required to pay the full amount for all Hire Item/s + security bond. Note: your booking is not secured and will be considered cancelled unless the invoice has been paid by the due date unless otherwise previously agreed by the Hirer.

4. Cancellation Policy

The Customer may cancel an order at any time, but acknowledges they will only receive 50% of the total for all Hire Item/s + security bond back.

5. Late Return Fees

A late return fee of 25% of the total for all Hire Item/s per day up to the maximum of the total booking fee amount will be charged where the Customer does not return the Hire Item/s by the return due date (4 days after pickup or deliver).

6. Damaged or Unreturned Hire Item/s Fees

The security bond will not be refunded if Hire Item/s are not returned or not in the same condition as when picked up or delivered.

7. Pickup or Delivery, Setup and Collection

Hire Item/s can be either:

  • picked up by the Customer at a location determined by the Hirer.
  • delivered, setup and collected by the Hirer from a location specified by the Customer.

If the Customer requests the Hirer to deliver, setup and collect the Hire Item/s, the Customer agrees to pay the relevant drop off or full service fee.

8. Use of Images for Advertising

The Customer consents to the Hirer using any online images displaying the use of the Hire Item/s, for advertising purposes only.

If the Customer requests the Hirer to deliver, setup and collect the Hire Item/s, the Customer consents to the Hirer taking photos of the setup Hire Item/s and using the images for advertising purposes only.

9. Responsibilities and Liabilities

Upon pickup or delivery and setup of the Hire Item/s, the Customer assumes all responsibilities and liabilities relating to the Hire Item/s while in their possession until they have been returned or collected by the Hirer. The Hirer shall in no way be held responsible or accountable for any injury, death or loss of income caused to the Customer, guests, staff at event venues or any third parties or properties through the use of the Hire Item/s.

3. Minors

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.
